ARTICLE 2 - SUBJECT
The subject of this agreement is the sale and delivery of the product that the BUYER orders from the SELLER's website, yadacosmetics.com, electronically, under the provisions of the Consumer Protection Law No. 4077 and the Regulation on the Implementation Principles and Procedures of Distant Sales Agreements, which determines the rights and obligations of the parties.
ARTICLE 3 - PRODUCT, PAYMENT, AND DELIVERY INFORMATION
3.1. The name, quantity, total price including VAT, payment method, and basic features of the product:

3.2. Payment Method: Credit card and Bank Transfer/EFT Payment
3.3. Credit Card Payment Conditions: Since installment sales can only be made with bank credit cards, the BUYER agrees to verify the related interest rates and late payment fees with their bank, and acknowledges that provisions regarding interest and late payment fees will apply according to the credit card agreement between the Bank and the BUYER.
Additionally, since installment sales are only provided by banks to their own customers, the BUYER agrees to verify the related interest rates and late payment fees with the bank and acknowledges that these provisions will apply under the installment credit agreement. The credit granting and detailed payment plan creation is at the discretion of the bank.
3.4. The SELLER makes the following commitment to the BUYER:
"The consumer has the right to cancel the contract without assuming any legal or penal liability and without providing any reason (and without paying any penalty) within seven days from the date the goods are delivered or the contract is signed. The SELLER commits to taking back the goods once the cancellation notice is received."
3.5. Right of Withdrawal: However, in accordance with the relevant legal regulations, there is no right of withdrawal for the following types of contracts: products made according to the consumer's special requests or personalized needs (including those modified or customized); cosmetics, food items with a short shelf life, or items that are not suitable for return due to their nature; CDs, DVDs, software programs, and computer consumables that have been unsealed; goods whose price is determined by organized markets such as the stock exchange; newspapers and magazines; services related to gambling and lottery; and all electronic services immediately performed online and any intangible goods delivered immediately to the consumer.
3.6. Notification of Exercise of Withdrawal Right: To exercise the right of withdrawal, the SELLER must be notified within the specified period. This notification can be made via letter or email (a durable medium) to the SELLER’s contact address as stated in this Agreement. In the case of the right of withdrawal, the product must be returned to the SELLER, and the cancellation request must include the return shipment documentation (such as a delivery receipt) and the original invoice. The product should be returned in its original packaging and condition, with all accessories, if applicable.
3.7. Return Invoice: If applicable, a return invoice must be issued. Returns without a return invoice will not be accepted for corporate orders.
3.8. Refund of Product Price: Once the necessary documents and the product are received by the SELLER, the product price will be refunded within 10 days. For credit card payments, the refund will be made to the BUYER's credit card.
3.9. Impossibility of Return: If there is a decrease in the value of the product due to use or the consumer's fault, the consumer must compensate for this loss or the full price of the product if it is impossible to return.
3.10. Return Procedure:
- a) Credit Card Payment Return Procedure: If the purchase was made with a credit card and installments, the BUYER will receive their refund in installments.
- b) Bank Transfer/EFT Payment Return Procedure: If the payment was made via bank transfer/EFT, the refund will be made to the BUYER's bank account.

Packaging, shipping, and delivery fees are to be paid by the BUYER. The shipping cost will be added to the total order amount and is not included in the product price. The product will be delivered by the agreed carrier to the address provided by the BUYER. If the BUYER is not available at the delivery address, the SELLER has fulfilled its obligation.
ARTICLE 4 - GENERAL TERMS
4.1. The BUYER confirms that they have read and understood the pre-information about the product on yadacosmetics.com and have provided electronic consent.
4.2. The product will be delivered within 30 days from the date of the agreement.
4.3. If the product is to be delivered to someone other than the BUYER, the SELLER is not responsible if the recipient refuses to accept the delivery.
4.4. The SELLER is responsible for delivering the product in the agreed condition, complete, and with any applicable warranty and instruction manuals.
4.5. The delivery of the product is contingent on the full payment being received by the SELLER.
4.6. If the product is delivered but payment is later canceled or not received by the SELLER, the BUYER must return the product.
4.7. In case of product defects or malfunctions, the product can be sent to the SELLER for repair or replacement, with shipping costs covered by the SELLER.
ARTICLE 5 - COMPETENT COURT
For the application of this agreement, the Consumer Arbitration Committees or the Ankara Consumer Courts are authorized.
Upon completing the order, the BUYER is deemed to have accepted all the terms and conditions of this agreement.
