Refund policy
In accordance with the Law No. 6502 on the Protection of Consumers ("Law"), buyers have the right to return products within 14 days from the date of delivery, without providing any reason and "without paying shipping fees."
- Consumer's Right to Withdrawal in Installment Sales Agreements:
The provisions related to installment sales agreements are regulated in Article 17 of the Law, and the right of withdrawal is regulated in Article 18.
The Regulation on Installment Sales Agreements was published in the Official Gazette dated 14.01.2015.
Accordingly:
Right of Withdrawal (1) The consumer has the right to withdraw from the installment sales agreement within seven days without providing any reason and without paying any penalty. (2) The withdrawal period starts from the day the contract is established for service contracts and from the day the consumer or a third party designated by the consumer receives the goods for goods contracts. However, the consumer may also exercise their right to withdrawal during the period between the establishment of the agreement and the delivery of the goods. (3) In contracts where the delivery of goods and the provision of services are performed together, the withdrawal provisions regarding the delivery of goods apply. (4) It is sufficient for the consumer to notify the seller or provider of the withdrawal in writing or by a durable medium within the withdrawal period. The seller or provider is obligated to prove that the consumer has been informed about the withdrawal right. (5) If the seller has delivered the goods to the consumer within the withdrawal period, the consumer may only use the goods to the extent required for an ordinary inspection. An ordinary inspection involves the initial examination of the goods. If the goods are used beyond regular inspection, the consumer cannot exercise the right of withdrawal. (6) In service contracts where the service has started with the consumer's approval before the withdrawal period ends, the consumer cannot use the withdrawal right. (7) The right of withdrawal cannot be used in financial leasing transactions initiated by the seller. (8) Other provisions related to the right of withdrawal, in favor of the consumer, in the Law remain intact.
Consequences of Exercising the Right of Withdrawal (1) If the consumer exercises the right of withdrawal, the seller or provider is obligated to return the amount received and any documents that have put the consumer under any obligation, within seven days from the date the withdrawal notice is received, without charging the consumer any additional fees. (2) The consumer must return the goods within seven days after exercising the right of withdrawal. Otherwise, the consumer is deemed to have not used the right of withdrawal. (3) The consumer must bear the return shipping costs when exercising the right of withdrawal.
- Consumer's Right to Withdrawal in Distance Contracts
The provisions regarding distance contracts are explained in Article 48 of the Law.
Distance contracts carry some risks for the consumer, similar to contracts made outside of the workplace. The defining feature of distance contracts is that the parties do not physically meet, unlike other contracts where parties usually meet in a store. The consumer, who concludes the contract through phone, internet, or mail from home, does not even see the seller or provider.
Therefore, in these cases, consumers should be informed about the contract and the performance and should be given a withdrawal right in compliance with the European Parliament and Council Directive 2011/83/EU, dated 25/10/2011, on Consumer Rights.
Withdrawal Right in Distance Contracts: (1) The consumer has the right to withdraw from the contract within fourteen days without providing any reason and without paying any penalty. (2) The withdrawal period starts from the day the contract is concluded for service contracts, and from the day the consumer or a third party designated by the consumer receives the goods for goods contracts. (3) For goods that are delivered in separate deliveries, the withdrawal period starts from the day the consumer or the third party designated by the consumer receives the last good.
Failure to Provide Sufficient Information (1) The seller or provider is required to prove that the consumer has been adequately informed about the withdrawal right. If the consumer is not informed correctly, the 14-day withdrawal period will not apply, and it will end one year after the original withdrawal period. (2) If the consumer is properly informed within the one-year period, the 14-day withdrawal period will start from the day the consumer receives the correct information.
Exercise of Withdrawal Right: (1) The withdrawal notice must be directed in writing or through a durable medium before the withdrawal period ends. (2) The consumer may use the form attached in the annex or provide an explicit declaration of withdrawal. The seller or provider must provide an option for the consumer to use the form or send the withdrawal declaration through the website. The seller must confirm the receipt of the consumer's withdrawal request immediately.
Seller's or Provider's Obligations: (1) The seller or provider must return all payments, including the delivery costs, within 14 days from the date the withdrawal notice is received. (2) The seller or provider must make the refund using the payment method chosen by the consumer without imposing any additional costs.
Consumer's Obligations: (1) Unless the seller offers to collect the goods, the consumer must return the goods within ten days from the notification of withdrawal.
Exceptions to the Withdrawal Right: The consumer does not have the right to withdraw from the following contracts unless otherwise agreed by the parties:
- Contracts for goods or services whose price is subject to financial market fluctuations.
- Contracts for goods made according to the consumer's specifications or personal needs.
- Contracts for goods that spoil quickly or have a short shelf life.
- Contracts for goods with opened packaging, seals, or hygiene-sensitive items, where returning is not possible.
